Bullis Charter School Files Suit Over 2012-13 Facilities

The charter school asks the Santa Clara County Superior Court to compel the Los Altos School District to provide a contiguous site for its K-8 program and a special master to oversee the allocation of 'reasonably equivalent' facilities.

 

Bullis Charter School filed suit Wednesday against the Los Altos School District, asking the county Superior Court to compel the district to provide “reasonably equivalent and accessible facilities” for the 2012-13 school year.

Los Altos School Board Trustee Doug Smith posted the filing of court papers on his blog.

The move comes before a decision in an , has been made.

In the new 26-page complaint, Bullis Charter School (BCS) asks the court to command the school district (LASD) to accommodate the K-8 charter school on a single site, provide appropriate teaching stations, a specialized classroom, and non-teaching station space.

It also asks, among other things, for:

  • LASD to provide BCS use of half the City Gym until a multi-purpose room is constructed, as was described in the final offer the district made and was accepted last spring
  • LASD to provide BCS with facilities appropriate for the enrollment projections BCS provided the district
  • the judge to declare the school district in violation of Proposition 39 and its implementing regulations, which require districts provide “reasonably equivalent” facilities to charter schools 
  • Court and attorneys fees

BCS asks that a special master be appointed to assume control of the process and allocate facilities to Bullis.

It also wants the court to exercise continuing jurisdiction over the action to ensure compliance.

The move was not unexpected. Following an , BCS lawyer Arturo Gonzalez had said he would recommend the filing, and board trustee Anne Marie Gallagher had said the board was committed to its quest for a contiguous campus.
